A Last Will and Testament is a legal document directing how and to whom a deceased person’s assets will be distributed upon that person’s death. A person who dies (a “decedent”) leaving a last will and testament means that the person died testate. Upon the decedent’s death, his/her Last Will and Testament must be filed with the parish district court where the decedent was domiciled. If the court determines that the last will and testament is valid, the district judge will issue an order to that effect and ultimately issue a judgment of possession ordering the distribution of the decedent’s assets. 

Living Wills

A living will is a written declaration by a person who either does or does not want to be kept alive by artificial means if that person is in a terminal and irreversible condition and their death is imminent with no reasonable chance of recovery. This declaration can also contain a do not resuscitate (“DNR”) order to be effective under the above circumstances.
