Probate Law/ Successions

Succession Attorney in Louisiana

A succession (called probate elsewhere) is the term used in Louisiana to refer to the judicial process which transmits to the successors of a deceased person the right to take possession of the deceased’s estate (property, rights, and obligations) after complying with the appropriate procedural requirements for issuance of a judgment of possession by the district court in the parish of the deceased’s domicile. The successors of a deceased person dying with a valid last will and testament (dying testate) are “legatees” of the deceased. The successors of a person dying without a valid last will and testament (dying intestate) are the deceased’s “heirs.”
